WATERTOWN, N.Y. -- A State Supreme Court Judge ruled that most of the claims made by a Jefferson County Sheriff's Deputy against the department will be thrown out.

Deputy Krystal Rice had sued the department, Sheriff John Burns, a lieutenant, and a detective for $50 million after she agreed to take topless pictures for an online sexual predator investigation back in 2006. Rice said she had signed a contract that said the photos would be returned to her and would remain secure. She says she hasn't been able to get them back and has been harassed over them. She filed suit claiming among other things, intentional infliction of emotional distress and loss of evidence.

But on Thursday, Justice James McClusky threw out every charge, but the fact they had a contract. She will not be allowed to sue for punitive damages, but can still proceed on that portion of her suit.
