ST. LAWRENCE COUNTY, N.Y. -- The Wayne Oxley trial continues into its third week of testimony and jurors heard statements from a key witness Tuesday.

This is Oxley's third trial for the 2005 murder of Bernard Trickey Jr. His first conviction was overturned and the second ended with a hung jury.

A key witness to the trial, John Shannon, was killed in a house fire several years ago, but his testimony remains a large part of the case. Tuesday the District Attorney read Shannon's statement's from Oxley's original preliminary hearing.

The defense claims Shannon borrowed Oxley's baseball bat, the same bat police say was used as the murder weapon. But in his original testimony, Shannon denied ever borrowing the bat and said Oxley told him he needed Shannon to get something out of his basement.

Shannon received numerous threats after his testimony against Oxley and after admitting he was a police informant.

The 2005 fire that claimed his life was ruled an arson and the case is still open.

The trial will resume Wednesday afternoon.
