Federal prosecutors seek new Bruno indictment

ALBANY, N.Y. --The legal troubles continue for Joe Bruno. The former Senate Majority could face a retrial. That's because federal prosecutors have assembled a grand jury, looking to indict him for a second time.

Legal Analyst Arnold Proskin said, “Maybe if it was Joe Blow they wouldn't do it again, but it's Joe Bruno and this, maybe they want to say we have a blemish because he walked last time, let’s get him and convict him this time.”

In 2009, a jury convicted Bruno on two counts of theft of honest services. He faced two years in p rison, but his sentence was delayed pending the outcome of a Supreme Court case challenging the honest services law. Last November, a federal appeals court threw out Bruno's verdict, but ruled the Republican could be retried by the U.S. Attorney's Office.

Proskin said, “I think it's double jeopardy. You can call it what you want but once you charge a person for doing a particular act and you say this is crime a, ok, now we'll call it crime b. That's double jeopardy and that's what the courts ultimately will have.”

E. Stewart Jones, one of Joe Bruno's attorneys was unavailable for comment. He has said in the past Bruno would not accept a plea deal, if one is offered.

Proskin says he hopes this all goes away quickly for the 82-year-old Bruno.

Proskin said, “I don't want to see him tried again. He's gone through it, he's been punished enough, but they have a right to do what they want to do.”
