The third trial for Wayne Oxley is officially underway. Oxley is accused of beating Bernard Trickey Jr. to death with a baseball bat in 2005. The two men were neighbors at the time. As our Cara Thomas tells us, the attorneys delivered opening statements Wednesday, followed by testimony from two witnesses.

ST. LAWRENCE COUNTY, N.Y. -- A handful of people came to opening statements Wednesday showing their support for Wayne Oxley. He is charged with murder in the second degree, accused of beating his neighbor, Bernard Trickey Jr., to death with a baseball bat.

This is Oxley's third trial. His first conviction was overturned and the second trial ended in a hung jury.

District Attorney Nicole Duve began opening statements with a detailed outline of the day Bernard Trickey was killed in his home in Ogdensburg. She described the scene on New York Avenue as gruesome and unfathomable to anyone who saw it. Duve also told the jury they would hear and see evidence and testimonies that continue to point back to Oxley.

The defense took a different approach. Peter Dumas told the jury they will be presented with a lot of evidence proving Bernard Trickey was murdered, but little evidence related to Oxley.

Testimonies from the two police officers who responded to the 911 call were heard Wednesday. Detective David Layng took the stand while testimony from Sergeant Kevin Fee was read by Duve. The officers both testified no one else was at or near the house when they arrived on the scene. Sergeant Fee testified that he identified a pool of blood in the living room after looking through the front door window.

And these two witnesses are only the beginning. Judge Richards warned the jurors during jury selections that the trial could last up to two months or more as the attorneys still have over 120 witnesses to go.

District Attorney Duve told the jury they will hear from police officers, investigators and the two people who found Trickey's body and made the 911 call.

The Oxley trial is scheduled to resume Friday morning.
